Terms of Service

The terms that apply when you use Outside! to discover things to do, save ideas, create plans, submit activities, and access paid features.

1. Agreement to these terms

These Terms of Service are a legal agreement between you and PaulSmith.Codes, the operator of Outside!. They apply to the Outside! mobile app, website, activity listings, subscriptions, planning tools, referral cards, sponsored listings, notifications, and related services.

By accessing or using Outside!, creating an account, starting a subscription, submitting content, joining a plan, or opening a shared link, you agree to these Terms and to any policies referenced here. If you do not agree, you must not use Outside!.

2. Eligibility and accounts

You must be at least 13 years old to use Outside!. If you are under the age of majority where you live, you may use Outside! only with permission and supervision from a parent or legal guardian.

You are responsible for the accuracy of the information you provide, for activity under your account, and for keeping your sign-in credentials secure. You must not impersonate another person or create an account for someone else without permission.

3. The Outside! service

Outside! helps people in Jamaica discover activities, save ideas, shake the Idea Jar, create plans, invite friends, submit activity ideas, report outdated information, and find experiences that match preferences such as vibe, budget, parish, and outing type.

Activity information, hours, prices, availability, safety conditions, maps, directions, contact links, and third-party content can change. Outside! does not guarantee that any listing, venue, route, business, or activity will be available, accurate, safe, suitable, or lawful for your particular circumstances.

4. Safety and real-world activities

You are responsible for your own decisions, transportation, personal safety, health, belongings, spending, and interactions with other people or businesses. Use judgment before visiting any place, accepting an invitation, relying on directions, or participating in an activity.

Outside! is not an emergency, travel, safety, medical, legal, financial, or transportation service. If you face an emergency, contact local emergency services or the relevant authority.

5. Plans, invites, and friends

When you create, join, accept, decline, leave, or cancel a plan, relevant plan details may be visible to the plan owner, invited participants, accepted participants, and people who receive a valid shared plan link. Only include information that you are comfortable sharing with those people.

You are solely responsible for communications, arrangements, payments, conduct, and decisions involving other users, friends, invitees, venues, businesses, or third parties.

6. User submissions and reports

You may submit activity ideas, reports, photos, notes, source links, contact details, business information, or other content. You represent that you have the rights and permissions needed to submit that content and that it is not unlawful, misleading, defamatory, private, infringing, harmful, or abusive.

By submitting content, you grant PaulSmith.Codes a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, review, moderate, edit, adapt, publish, display, distribute, create derivative works from, and otherwise use that content to operate, improve, market, and protect Outside!. We may approve, reject, edit, remove, or keep submissions for moderation, safety, audit, and legal reasons.

7. Sponsored listings and promotions

Outside! may show sponsored activity listings or promotional placements. Sponsored content will be labeled as Sponsored where required or appropriate. Sponsorship does not guarantee placement in organic recommendations and does not mean Outside! endorses, verifies, or guarantees the sponsor, activity, venue, product, availability, pricing, or quality.

Businesses may contact Outside! about promotions, but any sponsor-facing campaign, payment, cancellation, and placement terms may be governed by separate written terms.

8. Subscriptions, purchases, and trials

Outside! may offer paid features such as Outside Unlimited. Purchases, trials, renewals, cancellations, and refunds made through Apple or Google are processed by the relevant app store and are subject to that store's terms, billing rules, and subscription controls.

Deleting your Outside! account does not automatically cancel an App Store or Google Play subscription. You must manage or cancel subscriptions through the Apple App Store or Google Play account used for the purchase.

9. Account deletion

You may delete your account from the Profile screen in the Outside! app. Account deletion is intended to be permanent and will remove or anonymize personal app data associated with your account, subject to records we must keep for legal, security, fraud prevention, billing, audit, dispute, or operational reasons.

Owned plans may be cancelled so participants are not left with broken plan references. Deletion does not remove content that has already been transformed into public activity listings, but personal owner identifiers will be removed or anonymized where practical.

10. Acceptable use

You must not misuse Outside!, interfere with the service, attempt unauthorized access, reverse engineer protected parts of the service, scrape or bulk copy content, abuse invitations or reporting tools, submit spam, upload malware, harass others, impersonate anyone, violate intellectual property rights, or use Outside! for unlawful, deceptive, harmful, discriminatory, or unsafe purposes.

We may suspend, restrict, or terminate access, remove content, preserve records, or cooperate with legal requests if we believe your use violates these Terms, creates risk, or may harm Outside!, users, businesses, or the public.

11. Third-party services

Outside! may integrate with or link to third-party services, including Firebase/Google services, Apple, Google Play, RevenueCat, PostHog, maps and navigation apps, email apps, business websites, social platforms, JamPack'd, and app stores. Those services are independent and governed by their own terms and privacy policies.

PaulSmith.Codes is not responsible for third-party services, content, actions, omissions, prices, policies, availability, or security practices.

12. Intellectual property

Outside!, including its software, design, text, graphics, branding, original activity curation, logos, workflows, and other materials, is owned by PaulSmith.Codes or its licensors and is protected by intellectual property and other laws.

You may use Outside! only as permitted by these Terms. You may not copy, sell, sublicense, distribute, modify, publicly display, create competing datasets from, or exploit any part of Outside! except as expressly allowed by law or by written permission.

13. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless PaulSmith.Codes from claims, damages, losses, liabilities, costs, and expenses arising from your use of Outside!, your content, your plans or interactions, your violation of these Terms, or your violation of any law or third-party right.

14. Disclaimers

Outside! is provided on an as-is and as-available basis. To the fullest extent permitted by law, PaulSmith.Codes disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and uninterrupted operation.

We do not warrant that Outside! will be error-free, secure, always available, or that activity recommendations, plans, sponsored listings, maps, directions, user content, or third-party links will meet your needs.

15. Limitation of liability

To the fullest extent permitted by law, PaulSmith.Codes will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for losses arising from activities, venues, transportation, user interactions, third-party services, content inaccuracies, service interruptions, or unauthorized access.

Where liability cannot be excluded, PaulSmith.Codes' total liability for any claim relating to Outside! will be limited to the amount you paid to Outside! in the three months before the event giving rise to the claim, or JMD $15,000, whichever is greater.

16. Changes, suspension, and termination

We may update, suspend, discontinue, or change any part of Outside! at any time. We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you through the app, website, or another appropriate channel.

Your continued use of Outside! after updated Terms take effect means you accept them. You may stop using Outside! or delete your account if you do not agree.

17. Governing law and contact

These Terms are governed by the laws of Jamaica, without regard to conflict-of-law rules. Courts or tribunals located in Jamaica will have jurisdiction except where applicable consumer law requires otherwise.
